• The client will be charged unless the subscription is canceled before the trial ends
   
• It is the client’s responsibility to cancel before billing if they do not wish to continue
   

• All purchases are non-refundable by default
   
• Refunds are not automatic and are reviewed case-by-case at our sole discretion
   
• To request a refund, the client must text support and include:
   
  • Full name
     
  • Purchase date
     
  • Product purchased
     
  • Reason for the request
     

ClearCut Creations will respond with next steps and a decision as quickly as reasonably possible.

ClearCut Creations provides software, automation tools, and AI communication systems designed to help businesses manage leads, messages, calls, and appointments.

  • Pricing
     
  • Sales ability

• Artificial intelligence may respond to messages, calls, or chats automatically

By using our platform, you acknowledge that certain features—like Voice AI, SMS/MMS messaging, and toll-free numbers—may incur minimal third-party fees, including:

• Toll-free number rental ($2–$5/month)
   
• A2P registration/verification ($4–$15 one-time)
   
• Messaging (1–5¢ per SMS/MMS)
   
• Voice call usage (1–2.5¢ per minute)
   

AI features included in your subscription (Conversation AI, Voice AI, Content AI, Review AI) do not incur additional charges, unless you enable the AI Employee add-on ($99/month).

You are responsible for any telephony or messaging fees. We are not liable for delivery failures, delays, or carrier issues. Use of Phone Services must comply with all applicable laws and messaging regulations.

ClearCut Creations may collect and process business contact information such as:

• Names
   
• Emails
   
• Phone numbers
   
• Messages and appointment data
   

This information is used solely to provide and improve the service in accordance with our Privacy Policy.

To the maximum extent permitted by law:

• ClearCut Creations shall not be liable for indirect, incidental, or consequential damages, including:
   
  • Lost profits
     
  • Lost customers
     
  • Business interruption
    
     

By purchasing, subscribing, or using ClearCut Creations services, the client agrees to:

• Our Terms of Service
   
• Our Privacy Policy
   

If the client does not agree, they must not use the service.

ClearCut Creations LLC provides software, automation, communication, and related services that may involve the creation, receipt, maintenance, or transmission of Protected Health Information (“PHI”) on behalf of healthcare clients. When services involve PHI, ClearCut Creations operates as a Business Associate as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and a separate Business Associate Agreement (“BAA”) will be executed at or prior to onboarding.

Client Responsibilities (Covered Entity).
The Client remains solely responsible for its own HIPAA compliance obligations, including but not limited to:

• Determining what PHI is collected, stored, or transmitted
• Training staff and controlling user access to patient information
• Establishing internal privacy, security, and breach-notification policies
• Ensuring proper and lawful use of all communication features within the platform

ClearCut Creations does not control Client behavior, staff actions, or internal compliance procedures.

ClearCut Creations Responsibilities (Business Associate).
ClearCut Creations will implement reasonable administrative, technical, and physical safeguards consistent with HIPAA requirements, including use of HIPAA-capable infrastructure and execution of required BAAs. ClearCut Creations will limit routine communications to appointment reminders, confirmations, operational notices, and similar non-diagnostic messaging, and will not intentionally transmit detailed medical information through unsecured channels.

Restrictions on PHI Transmission.
Unless expressly directed and authorized by the Client in writing and permitted under HIPAA, ClearCut Creations will avoid inclusion of:

• Diagnoses, treatment details, images, charts, or insurance data
• Full dates of birth, Social Security numbers, or financial identifiers
• Any message content that directly links a medical condition to an identifiable individual

Clients acknowledge that standard SMS and unencrypted email may present privacy risks and accept responsibility for directing how such channels are used within their organization.

Data Access, Exports, and Safeguards.
ClearCut Creations will access PHI only as reasonably necessary to provide contracted services and will avoid unnecessary downloading, local storage, screenshots, or external transmission of PHI except when specifically requested by the Client and handled through approved secure methods.

Shared Compliance Acknowledgment.
HIPAA compliance is a shared responsibility. ClearCut Creations provides HIPAA-capable tools and safeguards, while the Client retains responsibility for lawful use, workforce compliance, and operational privacy practices.

Nothing in this section guarantees absolute compliance or risk elimination; rather, both parties agree to maintain reasonable and good-faith safeguards consistent with HIPAA and applicable regulations.
